Terms of service
General Terms and Conditions
1. Scope
These General Terms and Conditions apply to all orders placed through the Orvyn online store at www.orvyn.ch.
By completing an order, the customer accepts these General Terms and Conditions.
2. Offer and Conclusion of Contract
The presentation of products in the online store does not constitute a legally binding offer but an invitation to place an order.
A purchase contract is concluded when Orvyn confirms the order by email or dispatches the goods.
Orvyn reserves the right to reject orders for legitimate reasons, particularly in cases of suspected fraud, payment problems or product unavailability.
Orders may only be placed by persons who are legally capable of entering into the respective contract.
3. Products and Availability
Orvyn operates a curated online boutique with a changing selection of products available in limited quantities.
The products are carefully selected and sourced through external distributors and partners. Product availability is limited and may change at short notice.
4. Prices and Payment
Customers in Switzerland are shown prices in Swiss francs (CHF). Customers in the European Union countries served by Orvyn are shown prices in euros (EUR).
All displayed final prices include the applicable statutory taxes unless expressly stated otherwise. Shipping costs are shown before the order is completed at checkout.
Payments are made using the payment methods available in the online store. The goods remain the property of Orvyn until full payment has been received.
5. Delivery
Delivery is made to the address provided by the customer during the ordering process. The available delivery countries, shipping costs and estimated delivery times are displayed in the online store or at checkout.
The stated delivery times are estimates. Individual products may be shipped directly by our partners and from different European warehouses. Orders containing multiple items may therefore be delivered in separate shipments.
If additional taxes, customs duties or import charges may apply to a delivery, this will be indicated before the order is completed.
6. Withdrawal and Returns
Customers residing in the European Union have the statutory right to withdraw from the purchase contract within 14 days of receiving the goods without providing a reason.
For customers in Switzerland, Orvyn voluntarily provides a 14-day return period from the date the goods are received.
The goods may be handled to the extent necessary to establish their nature, characteristics and functionality. They must be returned complete and with all accessories, original labels, packaging, protective bags and other supplied components.
Further information about the process, return shipping costs and refunds can be found in our Returns and Right of Withdrawal Policy.
7. Legal Guarantee
Customers in Switzerland are entitled to the statutory warranty rights provided under Swiss law.
Customers residing in the European Union are entitled to the mandatory statutory guarantee and conformity rights of their country of residence. The statutory guarantee period for new goods in the European Union is at least two years from receipt of the goods.
In the event of a defect, customers are entitled to the remedies provided by applicable law, which may include repair, replacement, a price reduction or a refund.
8. Liability
Orvyn is fully liable for damage caused intentionally or through gross negligence and for damage resulting from injury to life, body or health.
In the event of a slightly negligent breach of an essential contractual obligation, liability is limited to the damage that was reasonably foreseeable at the time the contract was concluded.
Mandatory statutory liability provisions, including applicable product liability and consumer protection laws, remain unaffected.
9. Data Protection
Information about the processing of personal data can be found in the Privacy Policy available at www.orvyn.ch.
10. Applicable Law and Jurisdiction
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For consumers residing in the European Union, the mandatory consumer protection provisions of their country of residence remain unaffected. This choice of law does not deprive consumers of the protection granted by mandatory provisions of their country of residence.
The statutory places of jurisdiction apply. Mandatory places of jurisdiction for consumers remain unaffected.
